In Georgia, a divorce can only be obtained through court proceedings. The person seeking the divorce takes action by filing a "complaint" with the court. A copy of this complaint is served on the other spouse, usually by the sheriff or private processor. It is wise for any spouse who has been served with a complaint to consult a lawyer as soon as possible for help answering and possibly contesting statements in the complaint. The formal, written "answer" to the complaint is due with 30 days of service of the complaint. Disagreements in contested divorces in Georgia often center on a few key issues:

  • Child custody and visitation: Changes in Georgia law regarding child custody and visitation that went into effect on January 1, 2008 require parents to create a comprehensive and far-reaching parenting plan. You must file a proposed plan with the complaint or answer, and the final divorce decree will incorporate a permanent parenting plan.

  • Child support: On January 1, 2007, new child support guidelines went into effect in Georgia. It is often best to seek the guidance of a qualified lawyer to understand the nuances of these complicated new child support calculation methods.

  • Alimony: Alimony, or spousal support, may be granted to either a husband or a wife. It can be paid for a limited period or until the spouse remarries, cohabitates, or passes away.

  • Property division: Division of property can sometimes be complicated, especially when the division involves second homes, pension plans, investments, or family businesses.
