In Georgia, a divorce can only be obtained through court proceedings. The person seeking the divorce takes action by filing a "complaint" with the court. A copy of this complaint is served on the other spouse, usually by the sheriff or private processor. The formal, written "answer" to the complaint is due with 30 days of service of the complaint. Disagreements in contested divorces in Georgia often center on a few key issues:

You must file a proposed plan with the complaint or answer, and the final divorce decree will incorporate a permanent parenting plan.


• Child support: On January 1, 2007, new child support guidelines went into effect in Georgia. It is often best to seek the guidance of a qualified lawyer to understand the nuances of these complicated new child support calculation methods.


• Alimony: Alimony, or spousal support, may be granted to either a husband or a wife. It can be paid for a limited period or until the spouse remarries, cohabitates, or passes away.
