What Makes An Uncontested Divorce Better Than A Contested Divorce?
In most cases an uncontested divorce can be a far better answer for both spouses than a contested divorce. If you and your spouse can reach an agreement about the issues in your case, then an uncontested divorce is the best way to meet your needs. An uncontested divorce can save time, money, and the emotional stress of going to court. In many cases, agreeing on an uncontested divorce can allow you and your spouse to keep what savings you have instead of fighting through a contested divorce with attorneys fees that may take years to pay off.
While an uncontested divorce is certainly a simpler option than a contested divorce, it still requires an order and final decree from the Superior Court, not to mention resolving questions of jurisdiction, choice of forum, choice of law, child support calculations and a parenting plan.
Children also have an easier time with an uncontested divorce. How Do I Know If I My Divorce Will Be Uncontested?
A divorce is not "uncontested" unless there is a complete agreement between the parties. You and your spouse must carefully work out every detail: How will you arrange custody and parenting time for the children? Who will pay child support and how much? How will you manage finances? How will you divide your property? If you have not come to agreement about any of these matters, then your divorce is not "uncontested." In an "uncontested" divorce, the parties have reached a written agreement that is formalized and signed before the divorce is filed.
If you haven't agreed on everything, but agree on some or most things, don't lose hope. Even a contested divorce may not necessarily require a trip to the courthouse. An attorney may be able to assist you with the process of reaching a settlement.
How Long Does It Take To Get An Uncontested Divorce?
If there is agreement between the parties, the divorce is considered uncontested. An uncontested divorce may be granted 31 days after you and your spouse have completed the paperwork with us. After we explain the questionnaire to you most people prefer to take it home and complete the paperwork over the next day or so. We have had clients meet with us in the morning, complete all the paperwork in our office and we have filed the divorce that very afternoon. It really depends on what you and your spouse are comfortable with. You can take a few days to work on the details or you can wrap it up while you're here in the office. It's really up to you.
Do I Have To Go To Court To Get An Uncontested Divorce?
Almost never. We work hard to ensure we resovle all the issues in a manner that meets the local Court's requirements and in almost all our cases we can present this agreement to the court without the need for you to appear in Court. We present the agreement to the court on your behalf as a settlement agreement and, upon approval it is made an order of the court. The court's order, called a final judgment and decree, concludes the divorce.
How Do I File an Uncontested Divorce in Georgia?
We'll take care of that for you! Once we have finalized your paperwork with you we will file it on your behalf in the Superior Court and ensure your case is on the calendar. After the required 31 days have passed we will follow up with the Court to ensure the final decree is issued in a timely manner. We pay attention to all the details to make sure that things run smoothly and properly.
